IN THE MATTER OF Amendment to Resolution 02-09.24.r - sale of unneeded, obsolete, or unfit property by Internet Auction

WHEREAS, pursuant to Resolution 02-09.24.r, the Fairfield County Board of Commissioners expressed its intent to sell unneeded, obsolete, or unfit property by Internet Auction pursuant to Revised Code 307.12(C), and

WHEREAS, under the current process, surplus property is first listed under the Fairfield County online classified section of the Internet for 30 days after which unsold property is transferred to the live auction for an additional 30-day period, and

WHEREAS, having utilized the Internet Auction system to sell surplus county property on a continuous basis for a 12-month period, the Board has determined that certain changes to the process would further expedite the process, NOW THEREFORE

BE IT RESOLVED by the Board of County Commissioners, County of

Fairfield, State of Ohio:

SECTION 1: that the Board of Commissioners hereby determines that Section 4 of Resolution 02-09.24.r shall be rescinded and the practice of listing surplus property in the classified section of the Internet shall be discontinued.

SECTION 2: that the Board of Commissioners hereby determines that Section 5 of Resolution 02-09.24.r shall be amended to reduce the number of days during which the surplus property shall be listed on the live auction from 30 days to 15 days.

SECTION 3: that all other sections of Resolution 02-09.24.r shall remain in force.

SECTION 4: that the Assistant Fiscal Clerk provide notice of these changes on the Internet auction site.

A RESOLUTION OF THE BOARD OF COMMISSIONERS OF FAIRFIELD COUNTY EXPRESSING ITS INTENT TO SELL UNNEEDED, OBSOLETE, OR UNFIT PROPERTY BY INTERNET AUCTION

WHEREAS, The Fairfield County Board of Commissioners has determined that each year the county has surplus property, including motor vehicles acquired for the use of county officers and departments, and road machinery, equipment, tools, or supplies, which is not needed for public use, or is obsolete or unfit for the use for which it was acquired; and

WHEREAS, R.C. 307.12(C) allows for the sale of such property by internet auction; NOW THEREFORE

BE IT RESOLVED by the Board of County Commissioners, County of Fairfield, State of Ohio;

Section 1:

The Fairfield County Board of Commissioners declares its intent to sell by Internet Auction certain surplus property including motor vehicles acquired for the use of county officers and departments, and road machinery, equipment, tools, or supplies, which are not needed for the public use, or are obsolete or unfit for the use for which they were acquired.

Section 2:

By resolution dated September XX. 2002 The Board of Fairfield County Commissioners has declared its intent to sell property through the Internet.

Section 3:

The auctions shall be conducted on a continuous basis by accessing the Fairfield County surplus property through the Fairfield County website located at www.co.fairfield.oh.us.

Section 4:

The surplus property will first be listed under the Fairfield County online classified section of the Internet for 30 days in order that political jurisdictions from within Fairfield County can choose to identify such property to acquire at the place identified in the classified listing, and at the price indicated.

Section 5:

If the property is not acquired in the first 30 days of listing in the online classified section then the property will be transferred to the live auction listing for a period of no less than 30 days but such time may be extended at the discretion of Fairfield County in order to maximize the financial return to the County.

Section 6:

The County on an item-by-item basis may determine minimum price or reserve price for that item. Such information shall be available on the website.

Section 7:

Each item sold is sold “as is”. Fairfield County makes no warranties or representation regarding any surplus sold.



Section 8:

The County will direct the highest bidder where to pick up the surplus property through email notification or notification placed on the auction site.

Section 9:

A certified check shall be delivered to the County’s designated agent at the time the winning bidder acquires the property. The winning bidder will be notified by email within 10 days of the end date of the auction.

Section 10:

The highest bid for the surplus property is subject to approval by the Fairfield County Commissioners, and Fairfield County reserves the right to withdraw the offer if the highest bidder is purchasing the surplus for a use contrary to the health and welfare of Fairfield County or its citizens.

Section 11:

The Board of Commissioners shall conduct the auction, but has contracted with LightGov to provide the software necessary for completing the Internet auction.

Section 12:

The Board will advertise in a newspaper of general circulation once on the first Monday of January, April, July and October the existence of the online auction. In addition the County will post a second notice 15 days after the publication of such first notice in the same newspaper of general circulation.

Section 13:

The County will also post a notice of such Internet auction in a conspicuous place in the Courthouse on a continuous basis and in the County Auditor’s offices.

Section 14:

A notice will appear continuously on the County’s website that surplus property is available through Internet auction.
